High Speed Suspension.Special Hardship Orders allow Queenslanders who have lost their driver’s licence as a result of having exceeded the speed limit by 40 kilometres per hour or more to continue to drive for work and medical purposes only during their licence suspension. When a person has been caught exceeding the speed limit by 40 kilometres per hour, they will be issued with a 6-12 month driver’s licence suspension. Whilst challenging the infringement notice is always an option, if the Queenslander is guilty of the offence, the only remaining course of action left is the application for a Special Hardship Order. If granted, the Special Hardship Order will allow the Queenslander to continue driving for work or medical purposes only during their driver’s licence suspension period. |
Be aware, the successful application for a Special Hardship Order is quite arduous and substantial evidence of not only severe financial hardship but also proof that you are a fit and proper person to remain on the road must be tendered by way of detailed and properly drafted Affidavit materials.
Many persons assume that if some element of financial hardship can be shown that the Special Hardship Order will simply be handed to them. Not the case.
The starting point for Magistrates when dealing with High Speed Special Hardship Order applications is that the application is not a fit and proper person to remain on the road, by default of the fact that they travelled at the speed that they did in the first place.
We have seen many any applicant, both self-represented and with lawyers who do not truly specialise in Special hardship Order applications, leave the court room empty handed, as a result having not taken the evidentiary burden of both the ‘severe financial hardship’ and ‘fit and proper person’ requirements as seriously as they should have.
There is no right of appeal after a refused Special Hardship Order application.
